Typically the Seller pays both the listing REALTOR® and the buyer’s agent at closing so until July 1, 2024 our buyer representation was usually paid by the seller. NOW, after July 1, 2024, we are required by law to meet with a buyer prior to showing a home and having the buyer sign a Buyer Compensation Agreement. Every agent must do this! Sellers may have agreed to pay us but we now need to have an alternative way of getting paid if we are the agent representing the buyer. What worked for more than 60 years has had big changes in our industry. Don't panic - most sellers still understand that not paying the agent that brings the buyer to the home MAY cause their home not to be sold and there are other ways being developed every day to help a buyer be represented by an experienced Your Realty Link agent. Builders still also pay us to represent you. Always contact a Your Realty Link agent before you go to a new build community so we can sign you up properly with the builder. Builders do not reduce the sales price if you don't use a Realtor and have allowed for our commission when setting their prices SO it only makes sense to have your own representation. It’s FREE to you and the builder has a representative in the community working for his/her best interest. You should too! Search ONLY new construction homes.
This user-friendly website allows a buyer to search for homes and save favorites. There is an easy foreclosure search, address search and MLS number search too. The detail page is awesome! Find the local school info, lots of pictures, mortgage calculator and tips on buying and selling. A NOTE FROM MIBOR DISCUSSING BROKER RESPONSIBILITY - THIS IS LAW - Dispute over Earnest Money?
A growing number of members are calling the Professional Services department with questions about what to do with the earnest money if the parties can’t agree on the disposition. What responsibility does the broker have holding those funds? According to Indiana License Law, the broker holding those funds is NOT required to disperse the funds to either party when a contract is not executed unless a court issues an order for payment or both parties mutually agree upon release of the funds. The broker DOES however have a responsibility once notified one or more parties intend not to perform on the contract to either release the funds as mutually agreed upon or begin the release process described in 876 IAC 8-2-2.
To initiate the release process, the broker holding the funds must notify all parties via certified mail that the funds will be dispersed as stated in the letter unless 1. All parties enter into a mutual release or 2. One party initiates litigation within 60 days of the mailing of the certified letter.
